Who is Donald Fowler? Donald Fowler Investigation

Donald Joseph Fowler was a registered broker with Worden Capital Management until 2019. In 2019, the SEC won a jury trial against Fowler and Gregory T. Dean – they were “charged in January 2017 with fraud for excessively trading customer accounts using a trading scheme that generated hefty commissions for the broker but significant losses for his customers.”

According to FINRA’s BrokerCheck website for Public Disclosures, Donald Fowler has been the subject of 15 disclosures. Some of the more notable disclosures are as follows:

 

  • October 2019 – Customer Dispute – Pending. Allegations include breach of fiduciary duty, negligence, negligent supervision, fraud, breach of contract.
  • August 2019 – Customer Disputer – Settled. Allegations included fraud, misrepresentation, breach of fiduciary duty, negligent supervision and breach of contract.
  • July 2019 – Customer Dispute – Pending. Allegations include negligence, unsustainability, breach of fiduciary duty, breach of contract, negligent misrepresentation and omissions.
  • January 2017 – Civil – Final. “The Securities and Exchange Commission alleges that Donald J. Fowler (Fowler) and the other individual recommended to customers a high-cost trading strategy consisting of the excessive buying and selling of stocks. This strategy benefitted Fowler because the frequency of the trading generated substantial commissions and other fees. The customers who trusted Fowler and relied on his supposed stock-picking expertise, however, ended up with enormous losses.”
  • June 2016 – Customer Dispute. Settled for $400,000. Allegations included “churning or Excessive Activity, Unauthorized Trading, Breach of Fiduciary Duty, Negligent Failure to Supervise, Common Law Fraud.”
  • April 2015 – Customer Dispute. Settled for $90,000. Allegations included churning, unsuitability, negligent supervision, markup or commission abuse, breach of fiduciary duty
  • October 2014 – Customer Dispute. Settled for $350,000. Allegations included churning, negligence, unsuitability, overconcentration, and failure to supervise.
