Who are Gary Smith and Tyler Smith | H. Beck, Smith Investments & Retirement

Gary Clifford Smith was a registered broker with H. Beck until 2016. While he is no longer a broker, he is still an investment adviser registered with Head-Up Advisory since 2020. According to FINRA’s BrokerCheck, he is the subject of 11 disclosures.

 

Tyler Dean Smith was a registered broker and investment adviser with H. Beck until 2018. He was discharged after H. Beck found out that he “continued to engage firm clients jointly, with his father, ex-representative Gary Smith, who was previously discharged for cause. Specifically, email communications indicated a continuing business relationship and direct interaction between H. Beck clients and Gary Smith, with Tyler Smith’s knowledge, despite the Firm’s prohibition against such a relationship.”

  • September 2016 – Employment Separation After Allegations – Discharged. “Failure to follow firm policies regarding altering customer documents.”
  • June 2011 – Civil Bond. Payout: $5,000.
  • August 2010 – Customer Dispute – Settled. Settlement amount: $50,000. Allegations: “DPP [Delivered Duty Paid] products unsuitable and speculative based on their investment objectives and risk tolerance.”
  • September 2009 – Civil Bond. Payout: $5,000.
  • June 1992 – Regulatory – Final. Initiated by the SEC (Securities and Exchange Commission).  Allegations “… Smith violated the recordkeeping provisions of the adviser act by failing to keep required books and records and violated the reporting provisions of the advisers act…”

 

Prior to H. Beck, Gary was a broker registered with Carey Jemison & Company, Hibbard Brown & Co., FSC Securities Corporation, E. F. Hutton & Company, Dain  Bosworth Incorporated, and Merrill Lynch Pierce Fenner & Smith Incorporated.

According to FINRA’s BrokerCheck website for Public Disclosures, Tyler Smith is the subject of 2 disclosures:

 

  • December 2018 – Employment Separation After Allegations – Discharged. Allegations:”Registered Representative continued to engage firm clients jointly, with his father, ex-representative Gary Smith, who was previously discharged for cause. Specifically, email communications indicated a continuing business relationship and direct interaction between H.   • February 2016 – Customer Dispute – Closed. Allegations include “unauthorized trades, negligence on certain stocks, unauthorized increase in Net Worth and Liquid Net worth; Forgery; unauthorized trading/discretion.”
